Improving Protection from Disability Discrimination
A House of Lords judgement (Lewisham v Malcolm) made it more difficult for a disabled person to show that they had been discriminated against for a reason related to their disability (disability-related discrimination).
In the context of preparing for the Equality Act, the Government considered whether it needed to take a different approach following that judgment.
The Government proposed that, for the Equality Act, it should replace disability-related discrimination with the concept of indirect discrimination, which is used for other protected characteristics, such as sex and age. The Government consulted on the proposal.

The Equality Act 2010 received Royal Assent on 8 April and implementation of the majority of the Act will begin on 1 October 2010. Read more on the Equality Act page.
