Improving Protection from Disability Discrimination
A House of Lords judgement (Lewisham v Malcolm) made it more difficult for a disabled person to show that they had been discriminated against for a reason related to their disability (disability-related discrimination).
In the context of preparing for the Equality Bill, the Government considered whether it needed to take a different approach following that judgment.
The Government proposed that, for the Equality Bill, it should replace disability-related discrimination with the concept of indirect discrimination, which is used for other protected characteristics, such as sex and age. The Government consulted on the proposal.

The Government published its response to the consultation on 27 April 2009 to coincide with the publication of the Equality Bill.
